English Summary
Title

Supreme Court on Vande Mataram: No Punishment for Not Singing

Short Description
The Supreme Court of India clarified that citizens cannot face criminal prosecution or punishment for refusing to sing the National Song, Vande Mataram, citing the historic Bijoe Emmanuel case precedent. While a 2026 amendment to the Prevention of Insults to National Honour Act penalizes anyone who intentionally disrupts an assembly, it does not mandate passive individuals to sing. The ruling came during a plea filed by vocalist T.M. Krishna challenging a directive to sing the full six stanzas of the song, arguing it infringes on religious freedom under Article 25. The apex court emphasized that forcing citizens to sing violates constitutional rights.
