ನವದೆಹಲಿ,ಡಿಸೆಂಬರ್,9,2022(www.justkannada.in): 2018ರ ಕೊಲಿಜಿಯಂ ಸಭೆಯ ವಿವರಗಳನ್ನು ಕೋರಿ  ಆರ್ ಟಿಐ ಕಾರ್ಯಕರ್ತರು ಸಲ್ಲಿಸಿದ್ದ  ಅರ್ಜಿಯನ್ನ ಸುಪ್ರೀಂಕೋರ್ಟ್ ವಜಾಗೊಳಿಸಿದ್ದು, ಕೊಲಿಜಿಯಂನಲ್ಲಿ ನಡೆಸುವ ಚರ್ಚೆ ಬಹಿರಂಗಪಡಿಸಲಾಗುವುದಿಲ್ಲ ಎಂದು ತಿಳಿಸಿದೆ.

ಡಿಸೆಂಬರ್ 12, 2018 ರಂದು ನಡೆದ ಕೊಲಿಜಿಯಂ ಸಭೆಯ ವಿವರಗಳನ್ನು ಆರ್‌ಟಿಐ ಕಾಯ್ದೆಯಡಿ ಬಹಿರಂಗಪಡಿಸುವಂತೆ ಕೋರಿ ಅರ್ಜಿ ಸಲ್ಲಿಸಲಾಗಿತ್ತು. ಇಬ್ಬರು ನ್ಯಾಯಾಧೀಶರ ನೇಮಕದ ಕುರಿತು ಡಿಸೆಂಬರ್ 12, 2018 ರಂದು ನಡೆದ ಕೊಲಿಜಿಯಂ ಸಭೆಯ ವಿವರಗಳನ್ನು ಕೋರಿತ್ತು. ಅರ್ಜಿದಾರರಾದ ಕಾರ್ಯಕರ್ತೆ ಅಂಜಲಿ ಭಾರದ್ವಾಜ್ ಅವರು ಮಾಹಿತಿ ಹಕ್ಕು ಕಾಯ್ದೆಯಡಿ ವಿವರಗಳನ್ನು ಕೋರಿದ್ದರು. ಆದರೆ ಅದನ್ನು ನಿರಾಕರಿಸಲಾಯಿತು. ಅದನ್ನು ಅವರು ಪ್ರಶ್ನಿಸಿದ್ದರು.ಆ ಸಭೆಯಲ್ಲಿ ಹಾಜರಿದ್ದ ನ್ಯಾಯಾಧೀಶರೊಬ್ಬರ ಸಂದರ್ಶನಗಳ ಆಧಾರದಲ್ಲಿ ಪ್ರಕಟಿತವಾದ ಲೇಖನವನ್ನು ಅರ್ಜಿದಾರರು ಆಧಾರವಿಗಿಟ್ಟು, ಕೋರ್ಟ್ ಮೆಟ್ಟಿಲೇರಿದ್ದಾರೆ ಎಂದು ನ್ಯಾಯಮೂರ್ತಿ ಗಮನಿಸಿದ್ದಾರೆ.

ಅರ್ಜಿ ವಜಾಗೊಳಿಸಿರುವ  ಸುಪ್ರೀಂಕೋರ್ಟ್ , ಕೊಲಿಜಿಯಂ ಬಹು-ಸದಸ್ಯ ಸಂಸ್ಥೆಯಾಗಿದ್ದು, ಅದರ ತಾತ್ಕಾಲಿಕ ನಿರ್ಧಾರವನ್ನು ಸಾರ್ವಜನಿಕ ಡೊಮೇನ್‌ ನಲ್ಲಿ ತರಲು ಸಾಧ್ಯವಿಲ್ಲ ಎಂದು ನ್ಯಾಯಾಲಯ ಹೇಳಿದೆ. ಕೊಲಿಜಿಯಂ ಸಭೆಗಳಲ್ಲಿ ಚರ್ಚಿಸುವ ಯಾವುದೇ ವಿಷಯ ಸಾರ್ವಜನಿಕ ಡೊಮೇನ್‌ನಲ್ಲಿ ಇರುವುದಿಲ್ಲ. ಅಂತಿಮ ನಿರ್ಧಾರವನ್ನು ಮಾತ್ರ ಅಪ್‌ಲೋಡ್ ಮಾಡಬೇಕಾಗುತ್ತದೆ. ಕೊಲಿಜಿಯಂ ನಿರ್ಧಾರಗಳನ್ನ ಮಾತ್ರ ಬಹಿರಂಗಪಡಿಸಬಹುದು. ಆದರೆ ಕೊಲಿಜಿಯಂನಲ್ಲಿ ನಡೆಯುವ ಚರ್ಚೆಯನ್ನ ಬಹಿರಂಗಪಡಿಸಲು ಆಗಲ್ಲ ಎಂದು ಸುಪ್ರೀಂಕೋರ್ಟ್ ತಿಳಿಸಿದೆ.

New Delhi, December 9, 2022 (www.justkannada.in): The Hon’ble Supreme Court has dismissed the application submitted under the Right to Information Act, seeking the details of the Collegiums meeting held in 2018, mentioning that the discussion held in the Collegiums cannot be disclosed.
An application was submitted under the RTI Act, requesting details of the Collegium meeting held on December 12, 2018. The RTI activist Anjali Bhardwaj had submitted an application seeking the details of the Collegium meeting on recruitment of two judges. The Hon’ble court has dismissed the request. The applicant had questioned it. The Hon’ble Judge is said to have noticed that the applicant had sought the details based on an article published during the interview of the judges who was present in that meeting.
Dismissing the appeal, the Hon’ble Supreme Court has mentioned that the Collegium is a single-member body, and the decisions taken in it cannot be disclosed in public. “Any topic or issue discussed in the Collegiums meeting won’t be in the public domain. Only the final decision should be uploaded. However, discussions held in Collegiums cannot be disclosed,” the Hon’ble SC has said.
